ve esasları belirleyen Kurul kararı Resmi Gazete'de yayımlanarak yürürlüğe girdi. Buna göre, mahsuplaşma işlemleri piyasa işletmecisi tarafından yürütülecek, üretim ve tüketim miktarları ise saatlik bazda mahsuplaştırılacak. Düzenleme kapsamında, mahsuplaşmaya konu üretim ve tüketim tesislerinin aynı gerçek veya tüzel kişiye ait olması şartı korunurken, işlemler vergi kimlik numarası bazında gerçekleştirilecek. Üretim ve tüketim tesisleri, belirlenen usul ve esaslar çerçevesinde grup bazlı olarak ilişkilendirilebilecek. Yeni çerçevede, birden fazla tüketim tesisinin tek bir üretim tesisiyle eşleştirilebilmesine imkan tanınırken, aynı grup içinde yer alacak tüketim tesislerinin aynı abone grubunda bulunması gerekecek. Belirli koşullar altında farklı fatura dönemlerine sahip tesislerin de aynı grup içinde yer almasına izin verilecek. Mahsuplaşma sürecinde üretimin tüketimi aşması durumunda ortaya çıkan ihtiyaç fazlası enerji miktarı saatlik bazda hesaplanacak. Bu kapsamda, üretim miktarının belirlenen bedelli üretim limitini aşması halinde aşan kısım sistem kullanım bedeline tabi tutulacak, bazı durumlarda ise ilgili mevzuat çerçevesinde Yenilenebilir Enerji Kaynakları Destekleme Mekanizması'na (YEKDEM) bedelsiz katkı olarak değerlendirilecek. Düzenleme, bedelli üretim limitinin hesaplanması, takibi ve değişikliklerin kayıt altına alınmasına ilişkin usulleri de netleştiriyor. Bedelli üretim limitinin aşılması sonrasında mahsuplaşma devam ederken, ihtiyaç fazlası üretimin niteliği bu limit dikkate alınarak belirlenecek. Mahsuplaşma işlemlerinde kullanılacak veriler, şebeke işletmecileri tarafından ölçüm noktalarından temin edilerek piyasa yönetim sistemine aktarılacak. Bu kapsamda, üretim ve tüketim verilerinin doğruluğundan ve zamanında sisteme girilmesinden şebeke işletmecileri sorumlu olacak. Görevli tedarik şirketleri ise mahsuplaşma sonuçlarına göre lisanssız üretim tesislerine yapılacak ödemeleri gerçekleştirecek ve sistem kullanım bedeline ilişkin tahsilat süreçlerini yürütecek. Öte yandan, üretim ve tüketim tesislerinin ilişkilendirilmesi için başvuruların ilgili şebeke işletmecilerine yapılması gerekecek. Başvuruların değerlendirilmesi, veri kontrolü ve sonuçların bildirilmesi süreçleri belirli takvimler çerçevesinde yürütülecek. Düzenlemeyle birlikte, daha önce yürürlükte bulunan mahsuplaşma usul ve esaslarına ilişkin düzenlemeler yürürlükten kaldırıldı. Ayrıca 2026'ya ilişkin bedelli üretim limitine ilişkin geçiş hükmü de düzenleme kapsamında yer aldı.
