By JOE HUTCHISON, US SENIOR NEWS REPORTER Published: 13:07, 11 June 2026 | Updated: 13:28, 11 June 2026 A nurse who sued the owner of a hire car after she crashed it while texting has been called out over her entitled behavior in a blistering legal filing.  Gaila Palo, 42, sued Jose Arevalo in the Western District of Washington State in January of this year claiming he had illegally recorded her crashing his own car and posted the clip on social media, where it promptly went viral. Palo sued despite the camera clearly recording her breaking the law during the August 2025 crash. Washington banned drivers from texting behind the wheel in 2017.  She did not apologize for her dangerous driving.  In her original complaint, Palo accused Arevalo - who offered his car for rental using an app called Turo - of posting the video as an act of revenge which led to her being harassed online.  The crystal clear recording of her antics shows Palo texting for around 20 seconds, with her eyes on her screen for a large chunk of that time. At one point, she was even driving hands-free while attending to her cell phone before crashing the car.  Legal representatives for Arevalo last week filed a motion to have the suit thrown out saying that it should be dismissed in its entirety. Palo's original complaint alleged that by videoing her, Arevalo may have recorded phone conversations of hers, allegedly violating federal wiretap laws.  His lawyers responded to this directly while asking the judge to 'ignore' her suit because he did not record any phone conversations.   Gaila Palo, 42, sued Jose Arevalo in the Western District of Washington State in January of this year claiming he had illegally recorded her crashing his own car Palo sued despite the camera clearly recording her breaking the law during the August 2025 crash The legal takedown of Palo said: 'In her initial Complaint, Plaintiff presented a series of false and misleading allegations.  'For example, Plaintiff alleged the crash occurred following a “moment of distraction and panic” when Plaintiff made a “split-second decision” to “glance” at her phone.  'The irrefutable video evidence shows otherwise. Plaintiff did not act out of panic; and she did not merely “glance” towards her phone for a “split-second.”  'Rather, Plaintiff made a conscious decision to text while she was driving the car at a high rate of speed on a busy roadway – with Plaintiff’s eyes facing downward and with both hands typing messages on her phone – for more than 20 seconds.  'Then, after driving the car off the public roadway and crashing into a ditch, Plaintiff falsely claimed she had been forced off the road by a phantom driver.  'It was Plaintiff’s conduct and lies – and her concerted effort to hide the truth – that led to her undoing. And Plaintiff continued to perpetuate these lies when she filed her initial Complaint.' Palo was so distracted that the car eventually careened into a ditch and flattened a mailbox, and she was filmed screaming and swearing, the video showed.  When officers from the local sheriff's office arrived on the scene, however, Palo falsely claimed another driver had cut her off and forced her off the road. The car is seen here veering off the road after Palo continued to use her phone while behind the wheel, causing it to crash  Palo's original complaint alleged that by videoing her, Arevalo may have recorded phone conversations of hers The damage to the Nissan Leaf is seen here in a picture taken by Arevalo after the crash  Arevalo - who rented his car to Palo through the app Turo - said the crash resulted in damage to the motor, AC system and other vital parts which cost $4,900 to fix.  The Daily Mail has contacted Arevalo's lawyers for further comment.  Palo is also suing Turo, Meta, Reddit, YouTube and two news organizations for their part in sharing the video, which hit the headlines last fall.  Turo, Meta, Reddit and YouTube have all appointed lawyers to the suit, the Daily Mail approached each of them for comment prior to publication. Legal representatives for Meta filed a motion to dismiss saying the court did not have any jurisdiction over the company due to the company being incorporated in Delaware with a principal place of business in California, court papers said. Counsel for both Reddit and YouTube meanwhile asked the court to extend a deadline to allow them time to respond to the complaint, which was approved. Court papers indicate that legal representatives for Turo entered into confidential talks with Palo's lawyer over a potential settlement, but no agreement has yet been reached.  No attorney information was yet available to the two media companies mentioned in the original complaint. One of them was handed a default judgement by the court after missing key deadlines. The suit claimed that all of the defendants violated her privacy under federal law and asked for the social media companies mentioned to remove her image from their platforms. Her lawyer also filed the suit under the pseudonym 'GP' in an attempt to hide her identity. According to Palo's lawsuit, she was not aware when she picked up the rental vehicle, a Nissan Leaf, that it had an interior dash cam and that Arevalo had failed to disclose it. It added that she was 'unfamiliar' with the car and was 'rushing to return it' on time when she decided to start texting.  When officers from the local sheriff's office arrived on the scene, Palo lied that another driver had cut her off and forced her off the road Palo is seen here in a picture from 2013 alongside her husband Lee and their daughter Bethany 'In that moment - a split-second decision to glance at her phone to send a quick message about the return time - her attention lapsed,' the suit claimed.  According to the suit the collision with the mail box caused the air bag to deploy and left Palo 'physically shaken and scared.' It continued that, after the crash, Palo was 'disoriented and confused' when she 'formed the mistaken belief that perhaps another vehicle forced her off the road,' which she then told to two deputies from the Snohomish County Sheriff's Office. The suit continued: 'This account was mistaken. No other vehicle was involved. Ms. G.P.'s moment of distraction - her own error in judgment - was solely responsible for the accident.' The suit claimed that Arevalo then made a 'deliberate, calculated decision to punish' Palo by posting it on his Facebook page.  According to the suit his recording of her 'constituted criminal and civil violations of federal law and Washington law.' After it was shared online, where it went viral, Palo claimed her Instagram and Facebook profiles were targeted by online trolls who 'bombarded [her] with hateful messages and comments.' 'The harassment was vicious, dehumanizing, and relentless,' the suit claimed, adding that the comments were both 'explicit' and 'sexually demeaning.' After she watched the video, Palo claimed her life 'descended into a living nightmare from which she has not fully recovered.' The suit claimed that she experienced anxiety, panic attacks, depression and insomnia as a result of the video going public.
