أبريل 2026 - 13:45 القضاء الكندي.. يحاصر الفرشة و يفضح أساليبه الاجرامية A A A A Reset متابعة-إكسبريس لم يعد ما يُمارسه المدعو عبد المجيد التونارتي الملقب بـ”الفرشة” على  صفحات التواصل مجرد موضوع يمكن الجدال حول طبيعته الجنائية،  هذا السلوك الممنهج الذي يقوم على التشهير والتأليب وضرب السمعة خارج أي ضابط قانوني، يؤكده القضاء الكندي الذي أصدى يوم 20 ابريل 2026 أمرا قضائيا تمهيدا صيغ بشكل حاسم لوضع حد لما يمكن وصفه بالبلطجة الرقمية. ويعتبر الحكم الصادر عن المحكمة العليا بمقاطعة كيبيك، وتحديدًا بمحكمة مونتريال بتاريخ 20 أبريل 2026، إنصاف للمحامي عبد الفتاح زهراش، بعد أن تبين للمحكمة أن ما نُشر في حقه يتجاوز حدود النقد المشروع ويدخل في خانة التشهير، الذي قد يسبب ضررًا جسيمًا وغير قابل للإصلاح . كما استند الأمر القضائي الكندي إلى معايير دقيقة، من بينها وجود مظهر حق واضح لفائدة المدعي، وخطر حقيقي يتمثل في استمرار المساس بسمعته، إضافة إلى عنصر الاستعجال وترجيح كفة الأضرار لصالح الضحية. واستحضرت المحكمة الكندية الاجتهادات القضائية في تحليل الخطاب التشهيري، معتبرة في الوقت ذاته، أن المحتوى المنشور يحمل مؤشرات جدية على الإساءة ويستوجب تدخلًا فوريًا لوقفه. وبناءً على ذلك، أصدرت المحكمة أوامر صريحة لا تحتمل التأويل، حيث ألزمت “الفرشة” بحذف الفيديو موضوع النزاع من جميع المنصات الرقمية داخل أجل لا يتجاوز 24 ساعة من تاريخ التبليغ، ومنعته من نشر أي محتوى يتضمن عبارات سب أو قذف، سواء بشكل مباشر أو غير مباشر، بما في ذلك التعليقات أو إعادة نشر المحتوى، كما حظرت عليه أي شكل من أشكال المضايقة أو التهديد عبر الوسائط الرقمية، مع التأكيد على التنفيذ الفوري للحكم رغم إمكانية الطعن فيه. اللافت في هذا القرار، أنه لا يترك أي مساحة للمراوغة أو التسويف، وفي حالة عدم الامتثال لهذه الأوامر لا يُعتبر مجرد مخالفة بسيطة، بل يرقى إلى مستوى ازدراء المحكمة، وهي تهمة ثقيلة في النظام القضائي الكندي، قد تترتب عنها عقوبات مالية إضافية وإجراءات أكثر صرامة تمتد إلى متابعات ذات طابع جنائي، وهو ما يعني أن الاستمرار في نشر نفس الخطاب أو تجاهل أوامر الحذف والمنع، قد يحول القضية من نزاع مدني إلى مواجهة مباشرة مع سلطة القضاء. وتكشف هذه القضية بوضوح أنها بداية النهاية لهذه البلطجة وما  يُقدَّم  تحت غطاء حرية التعبير يمكن أن يتحول إلى ممارسة خطيرة عندما يُستعمل كأداة للتشهير المنهجي، وأن المنصات الرقمية لم تعد فضاءً خارج القانون كما يتوهم البعض. للإشارة، الرسالة التي يوجهها هذا الحكم واضحة وصارمة:
