bilgilere göre, daha önce birçok kez askeri müdahaleyle karşılaşan Türk demokrasisi, 2007 yılının nisan ayında Türkiye Büyük Millet Meclisinde (TBMM) yapılacak Cumhurbaşkanı seçimleri öncesi yeni bir muhtıra krizi yaşadı. Seçimler öncesinde 11. Cumhurbaşkanı için AK Parti'nin Abdullah Gül'ü aday göstereceği bilgisinin kulislere yansıması, bazı çevrelerce tepkiyle karşılandı. Dönemin Genelkurmay Başkanı Orgeneral Yaşar Büyükanıt'ın, Cumhurbaşkanı seçimleri öncesi 12 Nisan'da beraberindeki kuvvet komutanlarıyla düzenlediği basın bilgilendirme toplantısında sarf ettiği "Cumhurbaşkanı, Cumhuriyet'e sözde değil özde bağlı olmalıdır." sözleri, tartışmaların odağına oturdu. Büyükşehirlerde cumhurbaşkanı seçimleri bahane edilerek düzenlenen "Cumhuriyet mitingleri"nde, Gül'ün cumhurbaşkanlığına karşı çıkıldı. Seçimler öncesinde yaşanan bir başka polemik konusu ise 367 tartışması olarak tarihe yansıdı. Eski Yargıtay Cumhuriyet Başsavcısı Sabih Kanadoğlu, cumhurbaşkanı seçimi için Anayasa'da belirtilen 367 oyun sadece karar yeter sayısı değil aynı zamanda toplantı yeter sayısı için de gerekli olduğu tezini ortaya attı. Buna göre, oylamalara en az 367 kişinin katılması gerektiği, aksi halde sonucun geçersiz olacağı iddia edildi. Böylece Meclisteki sandalye sayısı 354 olan iktidar partisi, tek başına kendi oylarıyla cumhurbaşkanını seçemeyecekti. Yaşanan bu tartışmalar ışığında tarihler, seçimin ilk turunun yapılacağı 27 Nisan 2007 gününü gösterdi. Siyasi çevrelerde AK Parti'nin farklı bir isim çıkaracağı dillendirilirken Başbakan Recep Tayyip Erdoğan, beklenenin aksine Gül'ün adaylığından geri adım atmadı. 27 Nisan'da Abdullah Gül, 361 milletvekilinin oy kullandığı ilk tur oylamasında 357 oy aldı. Oylamanın hemen sonrasında CHP, seçimi Anayasa Mahkemesine taşıdı. Aynı gün gece saat 23.30'da Genelkurmay Başkanlığının internet sitesinde daha sonra "e-muhtıra" olarak anılacak basın açıklaması yayımlandı. "Türkiye Cumhuriyeti devletinin, başta laiklik olmak üzere, temel değerlerinin aşındırılması için bitmez tükenmez gayret gösterildiği hatta milli bayramlara alternatif kutlamalar yapıldığı" ifade edilen bildiride, şunlar kaydedildi: "Özetle, Cumhuriyet'imizin Kurucusu Ulu Önder Atatürk'ün, 'Ne mutlu Türküm diyene' anlayışına karşı çıkan herkes, Türkiye Cumhuriyeti'nin düşmanıdır ve öyle kalacaktır. Türk Silahlı Kuvvetleri, bu niteliklerin korunması için kendisine kanunlarla verilmiş olan açık görevleri eksiksiz yerine getirme konusundaki sarsılmaz kararlılığını muhafaza etmektedir ve bu kararlılığa olan bağlılığı ile inancı kesindir." "Muhtıra" olarak nitelendirilen bu açıklamanın ardından kabine üyeleri, gece boyu buna nasıl bir yanıt verileceğini tartıştı. Dönemin Hükümet Sözcüsü Cemil Çiçek, 28 Nisan saat 15.00'te, "Başbakan'a bağlı bir kurum olan Genelkurmay Başkanlığının herhangi bir konuda hükümete karşı bir ifade kullanması, demokratik bir hukuk devletinde düşünülemez." açıklamasını yaptı. CHP'nin başvurusu üzerine toplanan Anayasa Mahkemesi, 1 Mayıs'ta verdiği kararla "367 iddiasını" kabul ederek yapılan birinci tur oylamayı iptal etti. Toplantılarda yeter sayısı olan 367'nin bulunamayışı nedeniyle 11. Cumhurbaşkanı seçilemedi. Anayasa Mahkemesinin iptal kararı üzerine, AK Parti'nin teklifi ve tüm partilerin desteğiyle erken seçim kararı alındı. Mecliste ayrıca Anayasa'da bazı değişikliklere de gidildi. Meclisin aldığı karar sonucu 22 Temmuz 2007'de erken seçime gidilirken seçimlerde yüzde 46,6 oy alan Recep Tayyip Erdoğan liderliğindeki AK Parti, 341 milletvekili ile yeniden tek başına iktidar oldu. Seçimlerde CHP ikinci, MHP ise üçüncü parti olarak Meclise girdi. Cumhurbaşkanının halk tarafından, 5 artı 5 sistemiyle seçilmesini öngören düzenlemenin de aralarında yer aldığı anayasa değişiklikleri, 22 Temmuz'daki milletvekili seçiminin ardından halk oyuna sunuldu. Bu oylamada ise kayıtlı 42 milyon 690 bin 252 seçmenin yüzde 67,5'i sandık başına gitti. Geçerli oyların yüzde 68,95'i "evet", yüzde 31,05'i ise "hayır" yönünde oldu ve böylece anayasa değişikliği kabul edildi. TBMM'de tekrarlanacak Cumhurbaşkanı seçimlerinde bu kez MHP'nin oylamalara katılacağını belirtmesi, yeni bir 367 krizinin önüne geçti. Yeniden AK Parti'nin adayı olan Abdullah Gül, 20 Ağustos'ta yapılan Cumhurbaşkanı seçiminin birinci turunda 341 oy aldı. Gül, 24 Ağustos'taki ikinci turda ise 337 oyda kaldı. Anayasa'ya göre ilk iki turda üçte iki çoğunluk olan 367 sayısına ulaşılamadığı için 276 oyun aranacağı üçüncü tura gidildi. 28 Ağustos'ta yapılan üçüncü turda Abdullah Gül, 339 oy alarak Türkiye Cumhuriyeti'nin 11. Cumhurbaşkanı seçildi. Cumhurbaşkanı seçiminin sonuçlanmasının ardından eski CHP Genel Başkanı Deniz Baykal, "Köşk seçimi meşrudur, sonuca saygı duyacağız." açıklamasında bulundu. Tartışmaların sona ermesinin ardından muhtıra, 29 Ağustos 2011'de Genelkurmay Başkanlığının internet sitesinden kaldırıldı. Dönemin Genelkurmay Başkanı Orgeneral Yaşar Büyükanıt ise 8 Kasım 2012'de TBMM Darbeleri ve Muhtıraları Araştırma Komisyonunda metni bizzat kendisinin kaleme aldığını açıklarken bunun bir muhtıra değil "laiklik hassasiyetini ortaya koyan bir metin" olduğunu ileri sürdü. Büyükanıt hakkında e-muhtıradan 5 yıl sonra soruşturma açıldı. Şikayetler üzerine 2012'de başlatılan soruşturma, dosyanın tek şüphelisi Yaşar Büyükanıt'ın 21 Kasım 2019'da hayatını kaybetmesinin ardından kapatıldı.
