Teenager who murdered a British mother in her Australian home has reduced sentence thrown out

Mrs Lovell was stabbed in the heart after the then-17-year-old broke into her family's house in North Lakes, north of Brisbane, at 11.30pm on Boxing Day 2022.  Her husband Lee was wounded during the home invasion. The killer, who is now in his 20s, pleaded guilty to four offences, including murder, and was handed down a sentence of 14 years in May 2024. Whole noting his decision, Justice Tom Sullivan said the boy was required to serve 70 per cent of that time in detention, after he found the crime to be 'particularly heinous'. In August last year, his sentence was reduced on appeal by almost 18 months, meaning he was to serve a minimum of eight years and four months in prison. Justice David Boddice lowered the detention period to 60 per cent, citing the killer's guilty plea, 'genuine remorse and prospects of rehabilitation' as special circumstances under the Youth Justice Act. However, the High Court unanimously overturned the ruling on Wednesday, according to ABC News. 'I'm just really surprised by the outcome and I didn't think that it was going to be a positive result for us so to get that it's pretty amazing really,' Mr Lovell told The Courier Mail after the decision. 'I'm glad it's done and dusted now, especially after these past four months checking emails for some sort of verdict. 'I was really unhappy that he was allowed to appeal and we weren't. I suppose that was really heartbreaking... I just felt like if he should, then I should. 'But I do feel justified now that we've got this far and the original result has been reinstated, so that's been really good.' According to the Youth Justice Act, a person under 18 must not be detained for than 10 years unless handed down a sentence that would mean life imprisonment if they were an adult - or if a judge finds it to be 'particularly heinous', as was ruled in 2024. Gim Del Villar, the Queensland Solicitor-General, had also called for the sentence reduction decision to be set aside after the finding last year. 'The appeal court undermined the statutory scheme,' he told the High Court in April. He was found guilty of burglary and assaulting Mr Lovell, and was sentenced to 18 months' detention - time he has served. The Lovell's home invasion led to 'adult crime, adult time' changes in Queensland law that allow for youth offenders to face a mandatory life sentence for murder with a minimum 20 years before parole.
