Ryanair 'sacked' captain who used legal authority to extend cabin crew's rest period

Ryanair has allegedly sacked a captain stationed at its Barcelona base after he exercised his legally granted authority to extend rest periods for cabin crew members who had been working beyond their normal hours.

The SEPLA pilots' union, which represents a portion of Ryanair's pilot workforce in Spain, described the airline's decision as "deeply worrying."

According to the union, the termination risks discouraging captains across the industry from enacting their rights under Commander's Discretion and may now fear disciplinary action.

SEPLA said: "No commander should be forced to choose between protecting flight safety and protecting their employment."

The union confirmed it is pursuing every available legal avenue to reinstate the dismissed Captain.

European aviation is governed by a framework of rules limiting how long pilots and cabin crew can remain on duty.

These regulations, referred to as Flight Duty Limitations, were established by the European Aviation Safety Agency to mitigate the danger of accidents caused by fatigue.

Under these provisions, crews operating short-haul routes without dedicated onboard rest facilities face a legal cap of 13 hours for any single duty period.

However, when circumstances arise that could not reasonably have been anticipated, a captain may invoke Commander's Discretion to stretch this limit by as much as two additional hours.

This authority rests solely with the aircraft's captain, who must assess both their own fatigue levels and those of every crew member, before deciding whether an extension is appropriate.

In this particular case, the captain first used his discretion to extend his crew's duty period to complete the operation.

Upon returning to base, he then exercised a further element of that same authority to lengthen the minimum rest period assigned to the cabin crew.

It was this second decision, granting additional rest, that is said to have triggered formal disciplinary proceedings against him, ultimately resulting in his dismissal.

SEPLA noted Ryanair's own internal communication acknowledged the captain had used his entitled discretion both to finish the flight and to extend crew rest, yet these very actions formed the basis for his termination.

The union argued: "When a commander considers that operational circumstances require the use of discretion or that the rest initially planned may not be sufficient to guarantee a safe operation, he must be able to act exclusively according to his professional criteria, free from any pressure or fear of reprisals."

The European Aviation Safety Agency's own guidance makes clear that Commander's Discretion ought to be reserved for unforeseeable situations and that carriers should build sufficient slack into their rosters to prevent crews from routinely needing to invoke it.

Meanwhile, the European Cockpit Association contends that this is far from current practice and that carriers deliberately "pack pilot schedules" in full knowledge that delays are likely.

"They expect pilots to use Commander's Discretion to make the day work. It's no longer the exception - it's part of the plan," the association said.
