أبريل 2026 - 15:19 وهبي: الماستر شرط لولوج المحاماة والمباراة تحسم الكفاءة A A A A Reset متابعة أكد وزير العدل عبد اللطيف وهبي أن اشتراط شهادة الماستر لولوج مهنة المحاماة جاء عقب تدخل رئيس الحكومة عزيز أخنوش، الذي كان قد اقترح في وقت سابق اعتماد الإجازة، مشدداً على أن تنظيم الولوج إلى المهنة يجب أن يظل مؤطراً بمبدأ المباراة باعتبارها المحدد الأساسي للكفاءة، إلى جانب شروط السن والشهادات الجامعية. وأوضح وهبي، خلال اجتماع لجنة العدل والتشريع وحقوق الإنسان المخصص لمناقشة مشروع القانون رقم 66.23 المتعلق بتنظيم مهنة المحاماة، أن الوزارة منفتحة على مختلف المقترحات، بما في ذلك مراجعة شرط السن، بهدف تطوير شروط الولوج وضمان جودة التكوين. وفي ما يتعلق بإحداث معهد لتكوين المحامين، كشف الوزير أن طاقته الاستيعابية ستتراوح بين 100 و150 طالباً، مع التوجه لإطلاق التجربة نهاية يونيو المقبل بمدينة طنجة كنموذج أولي، قبل تعميمها تدريجياً على مدن أخرى مثل أكادير ومراكش وفاس، بعد تقييم المرحلة الأولى. وأشار المسؤول الحكومي إلى أن التكوين داخل المعهد سيركز على الجانب التطبيقي للمهنة، في حين ستتولى هيئات المحامين لاحقاً ترسيخ القيم المهنية والأخلاقيات، معتبراً أن إصلاح القطاع يمر عبر تشخيص دقيق للإشكالات وتعزيز معايير التأهيل. وبخصوص ولوج الأجانب، شدد وهبي على ضرورة احترام القوانين الوطنية، مؤكداً أن ممارسة المهن المرتبطة بالدولة تظل مشروطة بالامتثال للإطار القانوني، مع الحفاظ على العلاقة القائمة على الثقة بين المحامي وموكله. وفي ما يتعلق باستبعاد المدانين، دعا الوزير إلى اعتماد مقاربة أكثر صرامة، خاصة بالنسبة للجرائم الخطيرة، مع مراعاة خصوصية بعض الحالات، معتبراً أن وجود سوابق لا يجب أن يؤدي إلى منع مطلق في جميع الحالات. كما دعا إلى اعتماد مرونة أكبر في فتح المجال أمام بعض الفئات المهنية، مشيراً إلى وجود 32 موظفاً مؤهلاً لولوج المهنة دون أن يسلكوا هذا المسار، وهو الأمر الذي ينطبق أيضاً على بعض الأساتذة الجامعيين. وفي ختام مداخلته، جدد وهبي تمسكه بخيار المباراة بدل الاكتفاء بالإعلان عن امتحان، موضحاً أنه سيتم إحداث مجلس إداري لمعهد التكوين، وأن المتدربين سيخضعون لفترة تمرين مدتها سنتان تحت إشراف النقيب، قبل استكمال المسار وفتح مكاتبهم المهنية، مع الاستفادة من منحة خلال فترة التكوين. ويأتي هذا النقاش في سياق التداول في المادة الخامسة من مشروع القانون، التي تحدد شروط الولوج إلى المهنة، من بينها الجنسية المغربية أو الانتماء إلى دولة تربطها بالمغرب اتفاقية تعاون قائمة على مبدأ المعاملة بالمثل، إلى جانب شرط السن الذي يتراوح بين 21 و40 سنة عند تاريخ إجراء مباراة ولوج معهد تكوين المحامين. وعلى المستوى الأكاديمي، يُشترط في المترشح الحصول على شهادة الماستر أو ما يعادلها في العلوم القانونية، مع اجتياز مباراة الولوج بنجاح، واستيفاء فترات التكوين والتمرين لنيل شهادة الكفاءة المهنية، وفق المقتضيات القانونية الجاري بها العمل. كما يتعين أن يكون المترشح متمتعاً بحقوقه الوطنية وبقدرة صحية لمزاولة المهنة، وألا يكون قد صدر في حقه حكم نهائي في قضايا مخلة بالشرف أو المروءة، أو عقوبات تأديبية جسيمة، مع خلو سجله من أي إخلال بالالتزامات المهنية أو سقوط
