Ağır Ceza Mahkemesinde görülen davanın 16 Nisan'daki karar duruşmasında Bahtiyar hakkında verilen hapis cezasına ilişkin 49 sayfadan oluşan gerekçeli karar yazıldı. Kararda, Yargıtay 1. Ceza Dairesinin, Narin Güran'ın öldürülmesine ilişkin "suç delillerini yok etme, gizleme veya değiştirme" suçundan verilen 4 yıl 6 ay hapis cezası kararını, "nitelikli kasten öldürme suçuna yardım" kapsamında değerlendirilmesi gerekçesiyle bozmasının ardından Nevzat Bahtiyar'ın yeniden yargılandığı anımsatıldı. Kararda, Narin Güran'ın cansız bedenini Eğertutmaz Deresi'ne sakladığını itiraf eden tutuklu sanık Bahtiyar ile Narin'in babası Arif Güran, Aile ve Sosyal Hizmetler Bakanlığının ve taraf avukatlarının beyanlarına yer verildi. Amca Salim Güran ile Nevzat Bahtiyar'ın eskiden beri samimi ve yakın arkadaş oldukları ifade edilen kararda, sanık Güran'ın yeğeninin düğün merasimi hazırlıkları kapsamında kırsal mahalledeki bazı kişilerin alışveriş ve davetiye dağıtımı nedeniyle köyde bulunmadığı kaydedildi. Eylem saatinden önce sanıklar amca Salim, ağabey Enes, anne Yüksel Güran ile komşu Nevzat Bahtiyar'ın köyde olduklarının anlaşıldığı belirtilen kararda, şu değerlendirmede bulunuldu: "Sanıkların olay saatinden önceki zaman diliminde görüşmeye başladıkları anlaşılmıştır. Olaydan önce Nevzat Bahtiyar, Salim Güran'ı 15.08'de arayarak onunla irtibata geçmiştir. Kur'an kursundan çıkan maktul, her zaman kullandığı yol yerine daha kısa olduğu anlaşılan patika yolu kullanarak evine gitmiştir. Olay öncesinde sanıklar Salim ve Nevzat, birbirlerine yakın olarak maktulün her zaman kullandığı yol bölgesinde ve maktulün evi yakınında bulunmuştur. Maktulün ise patika yoldan çıkarak evi ve müştemilatının bulunduğu yere gelmesi üzerine buraya geçen sanık Salim ile evde bulunan diğer sanıklar Yüksel ve Enes tarafından maktul Narin'in öldürüldüğü anlaşılmıştır. Sanık Salim maktulün cesedini, olay öncesinde birlikte olduğu ve evin dışında bekleyen arkadaşı sanık Nevzat'a gizlemesi veya yok etmesi amacıyla teslim etmiştir. Bu hususu, sanık Nevzat ile sanık Salim'in saat 15.25 ile 15.46 sıralarında artan ortak baz kullanma durumu desteklemiştir." Kararda, sanık Bahtiyar'ın maktulün cesedini, yapılan aramalar sonucu cansız bedeninin bulunduğu derenin toprak ile birleşen kısmına çuval içinde götürerek bıraktığı ve üzerini taşla örttüğünün anlaşıldığı belirtildi. Kararda, "Sanık Nevzat'ın, sanık Salim'in ev içerisinde bulunan bir odaya kendisini götürerek Narin'in yerde yatan cansız bedenini gösterdiği, bu surette sanığın olay yerinde olmadığı şeklindeki beyan ve savunmalarına mahkememizce itibar edilmemiştir. Sanık Nevzat Bahtiyar'ın maktulün öldürülmesine ilişkin eyleme, sanık Salim Güran'ın yanında bulunarak suçun işlenmesinden önce ve eylem sırasında suç işleme kararını kuvvetlendirme, fiilin işlenmesi sonrasında yardımda bulunmak suretiyle öldürme eylemine yardım eden sıfatı ile katıldığı kanaatine varılmıştır. Sanık hakkında maktule yönelik eylemi nedeniyle Yargıtay ilamı doğrultusunda 'nitelikli kasten öldürme' suçuna yardım etme suçundan mahkumiyet hükmü kurulmuştur." ifadelerine yer verildi. Diyarbakır'ın merkez Bağlar ilçesinin Tavşantepe Mahallesi'nde 21 Ağustos 2024'te kaybolan ve 8 Eylül 2024'te Eğertutmaz Deresi'nde cansız bedenine ulaşılan Narin Güran'ın öldürülmesine ilişkin yargılanan tutuklu sanıklar anne Yüksel, ağabey Enes ve amca Salim Güran'a "iştirak halinde çocuğa karşı kasten öldürme" suçundan ağırlaştırılmış müebbet, Nevzat Bahtiyar'a ise "suç delillerini yok etme, gizleme veya değiştirme" suçundan 4 yıl 6 ay hapis cezası verilmiş, Diyarbakır Bölge Adliye Mahkemesi 1. Ceza Dairesi, ilk derece mahkemesinin sanıklara verdiği hükmü hukuka uygun bulmuştu. Yargıtay Cumhuriyet Başsavcılığınca, Narin Güran cinayeti davasında anne Yüksel, ağabey Enes ve amca Salim Güran'a verilen ağırlaştırılmış müebbet ile Nevzat Bahtiyar'a verilen 4 yıl 6 ay hapis cezasının onanması istenmişti. Yargıtay 1. Ceza Dairesi, tutuklu sanıklar Yüksel, Enes ve Salim Güran'a verilen ağırlaştırılmış müebbet hapis cezasını onamış, Nevzat Bahtiyar'a verilen 4 yıl 6 ay hapis cezasını ise "nitelikli kasten öldürme suçuna yardım" kapsamında değerlendirilmesi için bozmuştu.
