أبريل 2026 - 16:43 محمد عبد النباوي: 26 قاضية تتولين حاليا مهام المسؤولية بمختلف درجات المحاكم بالمملكة A A A A Reset أكد الرئيس الأول لمحكمة النقض، الرئيس المنتدب للمجلس الأعلى للسلطة القضائية، محمد عبد النباوي، الأربعاء 29 أبريل بالرباط، أن 26 قاضية تتولين حاليا مهام المسؤولية بمختلف درجات المحاكم بالمملكة. وقال  عبد النباوي، في كلمة خلال الجلسة الافتتاحية لمؤتمر دولي حول موضوع “مسارات النساء القاضيات : أزيد من 65 سنة من التجربة المغربية ورؤى متقاطعة”، إن “26 قاضية تتولين، في الوقت الراهن، مهام المسؤولية بمختلف درجات المحاكم بالمملكة، من بينهن رئيسة أولى لمحكمة الاستئناف، ووكيلة عامة للملك بمحكمة استئناف تجارية، ورئيسات محاكم ووكيلات الملك بعدة محاكم عادية أو متخصصة”. وأشار، في السياق ذاته، إلى أن نسبة المسؤولات القضائيات تمثل 10,62 في المائة من مجموع مناصب المسؤولية بالمحاكم، إضافة إلى رئيسة غرفة و6 رئيسات لهيآت قضائية بمحكمة النقض بنسبة تمثل 18 في المائة من مجموع مناصب المسؤولية بتلك المحكمة، مسجلا أن 67 امرأة قاضية تتولين مهام إدارية رفيعة بكل من المجلس الأعلى للسلطة القضائية، ورئاسة النيابة العامة، ووزارة العدل، والمعهد العالي للقضاء وقضاء الاتصال، فضلا عن وجود قاضيتين اثنتين ببعض المجالس الدستورية. وأضاف عبد النباوي أنه، انطلاقا من سنة 2017، دخلت القاضية المغربية محراب المجلس الأعلى للسلطة القضائية في شخص ثلاث قاضيات، هن ماجدة الداودي وعائشة الناصري وحجيبة البخاري، “ساهمن في تأسيس أول مجلس أعلى للسلطة القضائية المستقل عن السلطة الحكومية المكلفة بالعدل”، معتبرا أن القاضية المغربية استطاعات أن تثبت جدارتها في كل المهام التي تولتها. وتابع أن “المستقبل يعد بنمو أزهار كثيرة في بستان القضاء، ذلك أن نسبة النساء ضمن الفوج 49 للملحقين القضائيين الذين يتابعون تكوينهم حاليا بالمعهد العالي للقضاء بلغت 34,66 في المائة”، لافتا إلى أن المجلس أدرج موضوع تمكين المرأة القاضية ضمن أولويات استراتيجيته الحالية، حيث عهد إلى لجنة من أعضائه بوضع تقييم لوضعيتها ودراسة الأسباب والوسائل التي ترفع من قدراتها التنافسية على مناصب القيادة القضائية المختلفة. من جهته، أكد الوكيل العام للملك لدى محكمة النقض، رئيس النيابة العامة، هشام البلاوي، أن انعقاد هذا المؤتمر يعكس الاهتمام البالغ الذي توليه السلطة القضائية لموضوع تعزيز حضور المرأة في سلك القضاء وتوليها مناصب قيادية بما يتلائم والمكانة التي تحتلها المرأة في المجتمع، مذكرا بأن الارتقاء بالمساواة بين الجنسين “لا يعد ضرورة مجتمعية فحسب، بل هو تكريس لمقتضى دستوري ولحق من الحقوق الأساسية، وهذا ما جعل دستور 2011 يتبنى مقاربة ترسخ مبدأ المساواة بين الرجل والمرأة والسعي لتحقيق المناصفة”. وقال البلاوي إن “تحقيق المساواة بين الجنسين في مجال العدالة يأتي في مقدمة التحديات التي نواجهها اليوم، وهو امتداد لتحد أعمق وأوسع يجسده رهان تحقيق المساواة بين الرجل والمرأة في مختلف المجالات”، مشددا على أنه “إذا كان تعزيز تمثيلية المرأة على قدم المساواة مع الرجل يكتسي أهمية بالغة لارتباطه الوثيق بتحقيق التنمية داخل المجتمع عبر تحرير الطاقات النسائية، فإن تمثيل المرأة في الجهاز القضائي ينطوي على أهمية خاصة ودلالات رمزية بالغة”. كما اعتبر أن حضور المرأة القاضية يشكل مصدر إلهام كذلك للأجيال المقبلة من القاضيات من أجل تحفيزهن لتحرير طاقاتهن وتحقيق أدوارهن الطلائعية في مجال العدالة، مع الإسهام في تعزيز حماية الحقوق والحريات وتكريس مبدأ المساواة أمام القانون. وفي هذا الإطار، أشار البلاوي إلى أن المرأة المغربية كان لها السبق والريادة في ولوج القضاء على مستوى العالم العربي، حيث تم تعيين أول امرأة قاضية في السنوات الأولى لفجر الاستقلال وتحديداً في سنة 1961، مبرزا أن المغرب كان، أيضا، أول دولة على المستوى الإفريقي تعرف تعيين امرأة قاضية “وهذا السبق له أكثر من دلالة مما يعكس ريادة المملكة المغربية في السعي لإدماج المرأة في المناصب التي كانت في وقت من الأوقات حكرا على الرجال فقط”. من جانبها، أكدت الرئيس الأول للمجلس الأعلى للحسابات، زينب العدوي، على الحضور الفاعل للمرأة في عمل المجلس، منذ شروعه في ممارسة مهامه واختصاصاته بشكل فعلي خلال بداية الثمانينات من القرن الماضي، مبرزة مواصلة المرأة القاضية، أي قاضية الحسابات أو قاضية المالية، إسهامها النوعي في بناء صرح القضاء المالي المغربي منذ ذلك الوقت. وفي هذا الصدد، أوضحت العدوي أن قاضية الحسابات قطعت أشواطا هامة، لافتة إلى أن المجلس الأعلى للحسابات ضمن 30 في المائة من الأجهزة العليا للرقابة التي تقودها نساء “وهو أمر يشكل الاستثناء من بين مجموعة من الدول”، مسجلة أن نسبة القاضيات العاملات بالمحاكم المالية انتقلت، خلال حوالي أربعة عقود ونصف، من قاضية واحدة سنة 1984 إلى 117 قاضية سنة 2026، أي بنسبة تعادل 28 في المائة من مجموعة القضاة. واعتبرت أنه “خلال العشريتين الأخيرتين، لم يعد التحدي المطروح علينا هو ولوج النساء إلى مهنة القضاء المالي وإنما أصبح هو تعبئة قدراتهن النوعية الهائلة، وكذا تمكينهن من بلوغ مناصب التدبير والمسؤولية واتخاذ القرار رغم بعض الإكراهات والتحديات التي غالبا ما تكون موضوعية”، مضيفة أنه “بفضل اعتماد المساواة في إدارة المسارات المهنية وتثمين الكفاءات والمواهب وتشجيع الشباب والنساء التي اعتمدتها المحاكم المالية، تحققت قفزة نوعية في على مستوى وصول القاضيات إلى مناصب قيادية، حيث تضاعف عدد المسؤولات القاضيات، خلال السنوات الخمس الأخيرة، ليصل إلى 22 قاضية مسؤولة حاليا، أي بزيادة نسبتها 17 في المائة”. أما سفير الاتحاد الأوروبي بالمغرب، ديميتار تزانتشيف، فأوضح أن المساواة بين النساء والرجال داخل مؤسسات العدالة “ليست مجرد طموح بعيد المنال، بل هي ضرورة لمصداقية وفعالية دولة الحق والقانون”، مبرزا أنه منذ أكثر من 65 عاما، اختارت نساء متميزات سلك القضاء في المغرب. وسجل تزانتشيف أن “الاتحاد الأوروبي يشترك مع المغرب في قناعة أساسية تتمثل في كون العدالة العادلة هي تلك التي تشبه المجتمع الذي تخدمه، والعدالة التي تتواجد فيها النساء على نحو كامل، ليس فقط كقاضيات، بل كرئيسات محاكم، ووكيلات عامات، وعضوات في المحاكم العليا”. وأضاف أن من أبرز أهداف هذا الحدث الدولي هو تكريم النساء الرائدات في العمل القضائي بما ينسجم مع إدماج منظور النوع الاجتماعي في استراتيجيات الحكامة القضائية، منوها بالمجهودات التي ما فتئ يقوم بها المغرب لتعزيز حضور المرأة القاضية في مراكز المسؤولية، لاسيما عبر تحديث النظام القضائي وخلق إطار مؤسساتي قوي ومناسب. وأكدت المديرة العامة للديموقراطية وكرامة الإنسان في مجلس أوروبا، ماريا روتانن، على الأهمية التي يحظى بها موضوع القيادة النسائية في مجال العدالة، سواء بالنسبة للمملكة المغربية أو مجلس أوروبا، الشريك في تنظيم فعاليات هذا المؤتمر الدولي. ونوهت، في هذا السياق، بالتقدم الكبير الذي أحرزه المغرب في قضية تحقيق المساواة بين الجنسين على مستوى الحقوق والواجبات في مختلف مناحي الحياة العامة، لاسيما في مجالي العدالة والعمل القضائي خلال الأعوام الأخيرة. وإلى جانب الجلستين الافتتاحية والختامية، يتميز برنامج هذا المؤتمر الدولي الذي ينظمه، على مدى يومين، المجلس الأعلى للسلطة القضائية بشراكة مع كل من مجلس أوروبا والاتحاد الأوروبي واللجنة الأوروبية لفعالية العدالة، بعقد جلستين متخصصتين، تتمحور الأولى حول “رائدات القضاء، مسار تعزيز المكانة”، والثانية حول “الإصلاحات والدينامية المؤسساتية: نحو تعزيز الريادة القضائية النسائية”. كما يتخلل برنامج المؤتمر تنظيم مائدتين مستديرتين تتمحوران، على التوالي، حول موضوعي “نحو قيادة نسائية : مسار وإصلاحات وديناميات في السلك القضائي”،
