Ağır Ceza Mahkemesi'nde görülen davanın dördüncü duruşmasında Kara ve baklava kutusunda rüşvet aldığı öne sürülen eski Belediye Başkan Yardımcısı Mehmet Engin Tüter'in de aralarında olduğu 43 sanık, müştekiler ve taraf avukatları salonda hazır bulundu. Duruşmada tanık olarak dinlenen Aydın Temiz, Çevre, Şehircilik ve İklim Değişikliği İl Müdürlüğünde personel olarak çalıştığını, öncesinde Manavgat Belediyesi'nde görev yaptığını söyledi. Temiz, Zafer Süral ile tanıştığını ve sosyal hayatta da arkadaşlığının olduğunu belirtti. Sanıklardan S.C.B. ile de bir süre çalıştığını anlatan Temiz, "Zafer Süral'in otel tadilatı, inşaat ruhsatı ve iskan başvurularına yardımcı olmasıyla ilgili sanığa bir talep veya istekte bulunmadım." ifadelerini kullandı. Cumhuriyet savcısı, esasa ilişkin mütalaasında sanık Niyazi Nefi Kara'nın kamu gücünü kullanarak bir araya getirdiği kişilerle "suç işlemek amacıyla örgüt kurma", "rüşvet", "irtikap", "zimmet" ve "suçtan kaynaklanan mal varlığı değerlerini aklama" suçlarından cezalandırılmasını talep etti. Sanıklar Niyazi Nefi Kara, Mehmet Engin Tüter, M.T, M.B.Ç, M.K.S, S.C.B, H.C.G, M.K, B.Ş'nin Manavgat Belediyespor'a sebze ürünlerinin verilmesi ve faturasının kesilmesi nedeniyle "zimmet" suçundan beraatleri talep edildi. Tutuksuz sanıklar A.Ş, A.U.Y, A.D, A.O, C.Ç, Ç.G, E.G, F.Ö, H.C, K.T, M.G, M.T, M.K, S.Ü, S.Ö, Ş.B, Ş.I. ve Y.Ç'nin de "rüşvet" suçundan ayrı ayrı cezalandırılmaları istendi. Sanık Niyazi Nefi Kara, mütalaaya karşı savunmasında, üzerine atılı suçlamaları kabul etmediğini, suçsuz olduğunu ve beraatine karar verilmesini talep etti. Kendisine ve beraber çalıştığı diğer sanıklara kumpas kurulduğunu öne süren Kara, "Belediyede tehdit ve şantajlara boyun eğmedik, görevlerini en iyi şekilde yaptıkları için çalışma arkadaşlarıma teşekkür ediyorum. Hakkımızda iddiada bulunanlardan hiçbiri 'şu arkadaşıma, şu kadar para verdim' diyemiyor. Mehmet Engin Tüter'in makamında hediye kabul etmesi etik değildi, bizi üzmüştür ama bu da üzerimize oynanan kumpasın bir parçası." ifadelerini kullandı. İftiraya uğradıklarını iddia eden Kara, kimseden rüşvet almadıklarını, göreve geldikleri günden beri belediyenin borcunu yüzde 65'ten yüzde 20'ye düşürdüklerini ileri sürdü. Sanık Mehmet Engin Tüter ise dosyada örgüt iddiasının olduğunu ama aylarca telefonlarının dinlenmesine rağmen ortak baz kayıtlarının olmadığını ve örgüt suçlamasını kabul etmediğini söyledi. Hakkındaki suçlamaları reddeden, savunma sırasında gözyaşı döken Tüter, "Yaşadıklarımdan dolayı psikoloji diye bir şey kalmadı. Yaşananlardan dolayı eşimden özür dilerim. Ben gerçekten suç işleseydim de o zaman yatmak zorunda kalsaydım. Ama işlemediğim suç için tek kişilik yerde kalıyorum." dedi. Mahkeme heyeti, sanıkların tutukluluk halinin devamına, sanık ve avukatların mütalaaya karşı ek savunma yapması için duruşmayı 12 Mayıs'a erteledi. Manavgat Cumhuriyet Başsavcılığınca, otel tadilatı, inşaat ruhsatı ve iskan başvurularıyla ilgili rüşvet alındığı iddiaları üzerine başlatılan soruşturmada tutuklanan Niyazi Nefi Kara, belediye başkanlığı görevinden uzaklaştırılmıştı. Alınan ifadeler, ele geçirilen belge ve deliller ışığında genişletilen soruşturma kapsamında cumhuriyet savcısı gözetiminde yapılan yer gösterme ve arama işleminde, zirai depoda gizlenmiş 3 kilogram külçe altın, 500 bin avro ve 153 bin 160 dolar bulunmuştu. Kara ile belediye başkan yardımcıları, meclis üyeleri ve iş insanlarının da aralarında bulunduğu 41 sanık hakkında iddianame hazırlanmıştı. Manavgat Belediyesi içinde çıkar amaçlı suç örgütü kurulduğu, örgütün yöneticiliğini de Niyazi Nefi Kara'nın yaptığı ileri sürülen iddianamede, Kara'nın, kamu gücünü kullanarak bir araya getirdiği kişilerle "suç örgütü kurmak", "rüşvet almak", "zimmet" ve "irtikap" suçlarının birincil sorumlusu olduğu iddia ediliyor. İddianamede, "rüşvet" suçuna ilişkin ayrıntılara işaret edilip Manavgat Belediyesinde 2024-2025 yıllarında belediyedeki bazı izin, ruhsat ve imar işlemlerinde görevli kamu personeli ile yöneticilerin, bu süreçleri hızlandırmak veya usulsüzlükleri görmezden gelmek karşılığında menfaat sağladıkları belirtiliyor. Bu eylemlerin, Kara'nın yöneticiliğinde oluşturulduğu öne sürülen bir yapı tarafından organize edildiği savunulan iddianamede, "rüşvet gelirlerinin paravan şirketler aracılığıyla resmileştirildiği", belediye başkan yardımcıları, yakın akrabalar ve bazı müdürlerin de buna yardımcı olduğu aktarılıyor.
