On Monday, the secret was officially let out by Victoria's County Court and Ralph Carr's name and face was plastered across news sites all over Australia.  Anyone who had bothered to take a scroll through a Reddit post would have already known too well what was now legally fit for public consumption.  Online sleuths had worked it out ages ago and, unlike mainstream media, felt fit to put it in print for all to see.  The cynical view is Carr's name had only been suppressed because he was rich and powerful.  But wealth certainly has its advantages when it comes to getting a court to impose a gag order against all odds.  Those odds were put in Carr's favour by a high-priced lawyer and you might suggest a strategic and well-based grounding to get that order made based on sound legal principles.  In a nutshell, Carr played the mental health card.  Rapist Ralph Carr (right) and defence barrister Dermot Dann KC Celebrity agent Carr is seen on left with Molly Meldrum and Nick Giannopoulos But not just your average depression and embarrassment roll of the dice.  That alone won't cut it. Despite granting the most suppression orders in Australia, Victoria's justice system claims to have a very high barrier when it comes to getting a court to impose a gag order.  Basically, the accused needs to convince a judge that they are going to take their own life due to being outed.  It was an argument successfully won by Tom Silvagni to hide the fact he was charged with rape, until a jury finally convicted him.  Silvagni is the son of Australian Rules football royalty Stephen Silvagni and his former model and television hostess mum Jo.  Carr had told his psychiatrist if he was found guilty of rape, 'put me on the front page'.  But when he was, that gag order remained in place as his lawyers scrambled to extend the gag order that had banned media from naming him for three years. Carr's identity had been suppressed since September 2023 to protect his own safety from mental harm. They had fought hard to have their son's name kept out of the papers  The media, the Office of Public Prosecutions and the police officer who charged Carr all argued against the celebrity agent winning a cloak of anonymity. Police had argued Carr ought not have been granted special treatment by the courts. Carr was granted an interim suppression order until a full hearing could be listed.  Those hearings are usually heard within a few days of being made - thus the term 'interim'.  But Carr's high-priced barrister Dermot Dann KC managed to get the hearing pushed back for weeks. When it was finally heard, Carr had armed himself with four medical experts and collected supportive reports after telling them of suicide attempts he'd made years earlier, which he'd never before disclosed to anyone.  Those suicide attempts were all blamed on the media.  It was game over, and Carr's identity was suppressed.  Justin Quill is a partner at top tier law firm, Thomson Geer, and helped finally expose Ralph Carr  The proceedings pushed ahead in secret for years all the way up until Carr was convicted of the crime.  But even then it took days to be scrapped.  It is extraordinary for a suppression order to remain in place when a person has been convicted of rape, but there it was. Psychiatrist Dr Jacqueline Rakov, and two other medical experts, had earlier provided evidence in support of Carr being granted a suppression order. The psychiatrist, who also gave evidence in Silvagni's suppression bid, returned to the County Court witness box when Carr made a renewed application in 2024. She was prepared to do the same again on Monday, before he suddenly withdrew his application. Media lawyer Justin Quill, who acted for Daily Mail in fighting the gag order this week, suggested the protection of rapists with suppression orders on mental health grounds was not how the law was intended.  Ralph Carr had time to obtain medical experts to back his claims he would self harm if he was exposed by the media  He should know. Mr Quill was involved in the drafting of the very legislation Carr worked to hide his identity.  'And I can tell you no one thought about the 'safety' power being used to protect defendants and convicted rapists from suffering mental harm as a result of their charges or convictions being the subject of publicity,' he wrote in Monday's Herald Sun.  'But defendants now go along to psychiatrists and make assertions about their mental health, those assertions are then included in the psychiatrists' reports and can't be tested by the media or the Court.' The respected media lawyer wrote that, in Carr's situation, his assertions effectively become evidence even though they had never gone through the usual rigour evidence had to go through before being accepted as such. 'And this 'evidence' then forms the basis for a medical opinion that in turn supports a suppression order,' he stated.  'It's a house of cards built on untested assertions made by a defendant or convict who has a massive reason to lie with absolutely no downside in doing so.'
