İsrail Maliye Bakanı Bezalel Smotrich liderliğindeki Dini Siyonizm Partisi'nden Simcha Rothman ve Avigdor Liberman liderliğindeki İsrail Evimiz Partisi'nden Yulia Malinovsky tarafından sunulan tasarı, hem iktidar hem de muhalefet tarafından hazırlandı. Adalet Bakanı Yariv Levin, tartışmalı tasarının yasalaşmasından sonra yaptığı konuşmada, "Seçim arifesinde olmamıza ve var olan tüm anlaşmazlıklarımıza rağmen, bu anda birleşmenin bir yolunu bularak doğru şeyi yaptığımızı hissedebiliyoruz." dedi. Muhalefetteki İsrail Evimiz Partisi'nden tasarının altında imzası bulunan milletvekili Malinovsky, "Bunlar modern zaman Nazilerinin yargılamaları olacak ve tarih kitaplarına geçecekler." iddiasında bulundu. İsrail basını, 7 Ekim 2023'teki olaylara katıldığı iddia edilen 300 Filistinlinin alıkonulduğunu ve İsrail'deki çeşitli gözaltı merkezlerinde tutulduklarını aktarıyor. İsrail Meclisi'nde onaylanan yasaya göre, Aksa Tufanı Operasyonu'na karıştığı iddia edilen Filistinlilerin davaları, normal ceza davalarından farklı olacak şekilde özel bir askeri mahkemeye sevk edilecek. Filistinlilere karşı ayrımcılığın öne çıktığı özel bir yasal çerçeve olarak tasarı, mahkemenin bazı olağan delil ve usul kurallarını değiştirmesine izin verecek. Duruşmaların önemli anları kayıt altına alınarak görüntüler özel bir internet sitesi üzerinden yayımlanacak, video ile ses kayıtları devlet arşivlerinde saklanacak. İsrail basını, yasa uyarınca, mahkemenin Filistinlileri, "İsrail'in 1950 tarihli Soykırımı Önleme Yasası'nın hükümleri kapsamında soykırım, İsrail'in egemenliğine zarar verme, savaşa neden olma, savaş sırasında düşmana yardım etme ve İsrail'in 2016 tarihli terörle mücadele yasası kapsamındaki terör suçları dahil olmak üzere tüm ilgili suçlarla yargılayabileceğini" ve soykırım suçlamasıyla mahkum olanların idam cezasına çarptırılabileceğini yazdı. İsrail Meclisi, mart ayında İran'a saldırıların gölgesinde, Filistinli esirlere idam cezası getirilmesini öngören tartışmalı yasa tasarısını da onaylamıştı. Yasaya göre, "İsrail’in varlığını inkar etme amacıyla bir İsrailliyi veya burada yaşayan birini öldürmek" suçlamasıyla hüküm giyenler idam edilebilecek. Uluslararası hak ve hukuk örgütleri özellikle yasanın bu maddesinin "Filistinlileri" hedef almak için hazırlandığına dikkati çekiyor. İsrail Yüksek Mahkemesi, insan hakları ve hukuk örgütü "Adalah"ın başvurusu üzerine yasa hakkında 24 Mayıs'a kadar ihtiyati tedbir kararı getirmişti.
