By WAYNE FLOWER, SENIOR NEWS REPORTER, AUSTRALIA Published: 07:29, 29 June 2026 | Updated: 07:30, 29 June 2026 Two men were accused of murdering Jackson 'Jack' Gilmour - and one even shouted he did it - but despite both admitting the killing, neither will be branded a murderer. Mr Gilmour, 29, was shot dead in his bedroom in the early hours of December 2, 2024 at his Rye home on Victoria’s Mornington Peninsula. Charlyze 'Charlie' Hayter, 19, one of the group who entered Mr Gilmour's home at about 4am, was also shot dead during the incident.  'I f***ing murdered someone. Yeah, what a dumb c***,' one man was heard remarking after the fatal shot.  Mr Gilmour's girlfriend heard the killer's boast after she barricaded herself in the toilet as the attack unfolded in the adjoining bedroom.  Mason Matticoli, 25, and Tyler Vandesteeg, 30, had been accused of murdering the tradie.  On Monday, the Supreme Court of Victoria heard they had both accepted a deal to plead guilty to manslaughter.  Crown prosecutor Jeremy McWilliams told the court it remained unclear who fired the fatal shots, but both Matticoli and Vandesteeg knew the gun was loaded. Jackson Gilmour, 29, was shot dead in his bedroom in the early hours of December 2, 2024 at his Rye home on Victoria’s Mornington Peninsula Charlyze ‘Charlie’ Hayter, 19, one of the group who entered Mr Gilmour’s home about 4am, was also killed in the deadly attack The court heard the men had gone to the house intending to steal, armed with at least one loaded firearm.  They smashed windows and kicked in the front door just after 4am, waking Mr Gilmour, who confronted the intruders wearing only his underwear. His girlfriend, who was staying with him, hid in the toilet and called emergency services as the chaos erupted.  The court was told she heard Mr Gilmour demanding his belongings and a male voice yelling: 'I'm going to f***ing kill you.' Ms Hayter was killed by a single shotgun wound to the back of the head while Mr Gilmour died from a rifle shot to the chest.  The men fled with a black duffle bag containing methylamphetamine, a wallet, keys and a mobile phone.  The stolen car used in the raid was later set alight by a third co-offender, Jarod Smit, in a nearby street. Smit has pleaded guilty to the arson. The court heard Mr Gilmour had lived at the Rye rental property with his beloved kelpie cross dog Billy, described as 'the love of his life'  The court heard Mr Gilmour had lived at the rental property with his kelpie cross dog Billy, described as 'the love of his life'. He came from a close family, the eldest of five, with his family describing him as a loving, fun, caring, hardworking big brother and son who was a role model to his siblings.  He was a qualified tradie who had completed apprenticeships in both carpentry and plumbing.  The court heard Mr Gilmour was proud of his work, physically active and loved the outdoors.  His interests included surfing, snowboarding, mountain biking, fishing, swimming and going to the gym.  He had travelled extensively, including trips to Europe, America, Port Douglas, the Great Barrier Reef and Banff in Canada, where he lived and worked for a couple of years.  But the court heard the young tradie had lost his way in recent times, and turned to drugs for comfort and some extra cash.  The court heard Hayter, his ex-partner, had contacted him that night seeking drugs. Mr Gilmour responded via message that he could 'probably get her the drugs she had requested'.  The stolen car used in the raid was later set alight by a third co-offender, Jarod Smit (pictured), in a nearby street. Smit has pleaded guilty to the arson  Mason Matticoli, 25, and Tyler Vandesteeg (pictured), 30, had been accused of murdering the tradie which they denied, but both pleaded guilty to manslaughter The court heard Mr Gilmour's death had torn his family apart.  'No parent deserves to lose a child under such horrific circumstances,' his father, Andrew Gilmour, said.  'Jackson had his whole life ahead of him. He worked hard, he was a tradie ... I will never see my son Jackson ever again.' Younger brother Sam described Mr Gilmour as 'the best big brother I could have ever asked for'.  'My heart will forever be broken,' he said. 'I love you, Jack.' Mother Kim told the court she would never recover from her son's loss, but expressed concern for his killers.  'I hope that they can use this time in front of them to find a new way, a better way,' she said.  His sister Letitia described her brother as a role model.  'Almost two years ago, my life changed forever. I lost my brother right before starting university,' she said.  'Jackson wasn't just my brother. He was a role model ... his absence has left a permanent hole in our lives.  'I miss his voice. I miss his firm, comforting hugs. I miss his face. Most of all, I miss simply being his sister.' The pair will be sentenced at a date to be fixed.  No comments have so far been submitted.
