'When my school allowed a biological male into the girls' restroom without telling parents, I went to the school board,' she said. 'I got bullied for it. Harassed online. Even some of my own teachers came after me. 'I didn't speak up because it was easy. I spoke up because somebody had to.' Frei, a rising senior and athlete at New Richmond High School, went on to argue in favor of trans-athlete bans based on her experience as a volleyball and track player. 'Here's what I know. The net in women's volleyball is set nearly a foot lower for a reason. A biological male can hit a ball across that net at force that could seriously injure a girl,' she said. 'And in track, all it takes is three biological males entering the girls' category and not a single girl in this state stands on a podium.' She is one of several students involved in a lawsuit filed in April by the Wisconsin Institute for Law and Liberty (WILL), which represents the New Richmond Parents for Strong Schools, a group of parents and students. The lawsuit alleged that the New Richmond School District's bathroom policy violates the rights of high school girls under Title IX. 'The aforementioned policy has resulted in at least one biological male being present in the girls' bathrooms while biological girls were present, causing anxiety and stress for the girls,' the lawsuit stated. 'Female students now avoid restrooms, miss class time, and experience anxiety and loss of privacy, while being directed to use separate, single-stall bathrooms if they are uncomfortable.' When the lawsuit was filed, Frei said, 'Protecting girls by not allowing boys in the girls' bathroom shouldn't be controversial - it should be common sense.  Frei is one of several students involved in a lawsuit against the school district arguing the policy violates Title IX On Tuesday, the Supreme Court overturned decisions by lower courts that sided with trans students who challenged bans in Idaho and West Virginia 'We are not going to abandon our identity as girls or ignore the real privacy concerns the school district has forced on us.'  While the court filing lists the students and parents by their initials, one student, identified as E.F., claimed she was told to use the single-stall bathrooms when she told school administrators the presence of the biological male made her uncomfortable.  'E.F. misses class time because all of the single-stall bathrooms are located on the opposite side of the school from her classrooms, requiring her to walk a long distance each time she needs to use them,' the lawsuit said. 'E.F. is also forced to miss parts of her lunch hour in order to use the single-stall bathrooms. One of the single-stall bathrooms designated for girls' use has wait times because it is located in the teacher lounge and often occupied by staff.' The filing continued, 'E.F. experiences significant anxiety and discomfort over the possibility that male students may also be allowed in girls' locker rooms.' Court records show that the school district has filed a motion to dismiss the case, and a judge has not yet ruled on the matter. The Daily Mail contacted New Richmond High School, the school district, their attorneys, the superintendent, WILL and the New Richmond Parents for Strong Schools for comment.
