hazırlanan MASAK raporunda, Alihan Kuriş ve eşi ile her iki tarafın birinci ve ikinci derece yakınlarının mal varlıkları ile mali hareketleri incelendi. Savcılığın talebi doğrultusunda özellikle aile üyelerinin 2016 sonrasındaki mal varlığı değişimlerinin araştırıldığı raporda, mali profiller ile mal varlıkları arasındaki uyum, aile içi taşınmaz devirleri, tapu hareketleri ve bazı para transferlerinin kaynağı üzerinde duruldu. Raporda yer verilen aile fertlerinin TAKBİS kayıtlarına göre, Alihan Kuriş'in annesi Ayşe Gülderen Denizolgun Kuriş adına 646, babaannesi Nevin Kuriş adına 539, babası Mahmut Sabri Kuriş adına 207, eşi Seda Kuriş'in babası Mustafa Kösemusul adına ise 426 gayrimenkul işlem kaydı bulundu. Böylece bu dört isim bakımından toplam 1818 TAKBİS işlemine ulaşıldı. Söz konusu sayı, 1818 ayrı taşınmaz bulunduğu anlamına gelmese de TAKBİS işlem kayıtlarında satış ve alımların yanı sıra miras intikali, tevhit, ifraz, cins değişikliği, elbirliği mülkiyetinin sona erdirilmesi, kat irtifakı ve kimlik düzeltme işlemleri de yer alıyor. Bu büyüklükteki hareketliliğin, taşınmazların edinim ve devir zincirlerinin ayrıntılı şekilde incelenmesini gerektirdiğine işaret ediliyor. Raporda, Ayşe Gülderen Denizolgun Kuriş'in kayıtlarında tespit edilen tapu işlemlerinin yalnızca konut veya arsayla sınırlı olmadığı, büro, dükkan, imalathane, kahvehane, lokanta, mesken, zeytinli tarla, kuyulu tarla ve çeşitli arsaları kapsayan çeşitli taşınmazları kapsadığı belirlendi. Ayşe Gülderen Denizolgun Kuriş'e, İbrahim Hakkı Kuriş, Mahmut Sabri Kuriş ve Denizolgun ailesinin bazı üyelerinden çeşitli taşınmazların geçtiği görüldü. Bazı taşınmazların ise üçüncü kişilere veya şirketlere devredildiğine ilişkin kayıtlara ulaşıldı. Raporda, bazı taşınmazlar üzerindeki haciz ve tedbirlere de yer verildi. Bir parsel üzerinde 10 icrai haciz ve 4 ihtiyati tedbir, başka bir parselde ise 6 icrai haciz ve 4 ihtiyati tedbir bulunduğu tespit edildi. MASAK raporunda, 646 tapu işlemiyle birlikte taşınmazların edinim kaynakları, satış bedelleri ve aile ile şirketler arasındaki devir zincirlerinin ayrıca incelenmesi gereken konular arasında olduğu değerlendirildi. Alihan Kuriş'in kardeşi Hilmi Tuna Kuriş'in taşınmaz kayıtlarında, özellikle 2024-2026 döneminde miras, elbirliği mülkiyetinin sona erdirilmesi, tevhit ve satış işlemlerinin yer aldığı görüldü. Hilmi Tuna Kuriş'in babası Mahmut Sabri Kuriş'ten 2016'da üç katlı betonarme ofis, iş yeri ve arsa devraldığı, babasının 2024'teki vefatının ardından ise Adapazarı ve Sultanbeyli'deki çeşitli tarla ve arsaların kendisine intikal ettiği belirlendi. Kayıtlarda, 14 Şubat 2025'te aynı taşınmazlar üzerinde peş peşe elbirliği mülkiyetinin sona erdirilmesi ve satış işlemlerinin gerçekleştirildiği, 2670/6 parseldeki arsanın da aynı gün Hıdır Öztürk'e satıldığı bilgisi yer aldı. Hilmi Tuna Kuriş'in 29 Aralık 2025'te Üsküdar'da Osman Aslanali'den ahşap ev niteliğinde bir taşınmaz edindiği, 2026'da ise aile üyelerinden yeni taşınmazların kendisine intikal ettiği belirlendi. İncelemede, Hilmi Tuna Kuriş'in bazı taşınmazları üzerinde 8 icrai haciz, ihtiyati tedbirler ve iki ayrı el koyma kararı tespit edildi. Raporda, miras yoluyla edinilen varlıkların kısa süre içinde yeniden yapılandırılması veya üçüncü kişilere devredilmesi ile banka hareketlerinin birlikte karşılaştırılmasının önem taşıdığı ifade edildi. Raporda, Alihan Kuriş'in 29 Nisan 2024'te hayatını kaybeden babası Mahmut Sabri Kuriş'in mal varlığına ilişkin kayıtlar da incelendi. Mahmut Sabri Kuriş'e, annesi Nevin Kuriş'in vefatının ardından 2022 ve 2023 yıllarında çok sayıda arsa, tarla, daire, dubleks mesken, dört katlı betonarme mesken ve arsasıyla 3 adet üç katlı betonarme apartman ve arsası ile diğer taşınmazlar intikal etti. Mahmut Sabri Kuriş'in vefatının ardından bu mal varlığının bir bölümü, başta Alihan Kuriş ve kardeşi Hilmi Tuna Kuriş'in de aralarında bulunduğu diğer mirasçılara geçti. Raporda, Nevin Kuriş'ten Mahmut Sabri Kuriş'e, ardından Alihan Kuriş ve Hilmi Tuna Kuriş'e geçen taşınmazların hangilerinin miras, hangilerinin bedelli satış yoluyla devredildiği, varsa satış bedellerinin banka hesaplarına yansıyıp yansımadığı ve taşınmaz değerleriyle beyan edilen mali kaynakların uyumunun karşılaştırılmasının önem taşıdığı dile getirildi. Alihan Kuriş'in 22 Mart 2022'de hayatını kaybeden babaannesi Nevin Kuriş'in tapu geçmişinde de çok sayıda taşınmaz kaydı yer aldı. Nevin Kuriş'in tapu kayıtlarında dükkanlı kargir evler, dört katlı betonarme bina ve arsası, çok sayıda arsa ve tarla, çayır, yol, daire, dubleks mesken ile çeşitli yapılı taşınmazların bulunduğu görüldü. Nevin Kuriş'in vefatının ardından 2022'de çok sayıda taşınmaz, Mahmut Sabri Kuriş ve diğer mirasçılara geçti. Mahmut Sabri Kuriş'in de 2024'te vefat etmesiyle bu taşınmazların bir bölümü kısa süre içinde iki ayrı miras ve intikal sürecinden geçerek sonraki kuşağa ulaştı. Raporda, Nevin Kuriş'ten intikal eden taşınmazların sonraki süreçte satışa konu edilip edilmediği, üçüncü kişilere hangi tarihlerde ve hangi bedellerle devredildiğinin ayrı bir mal varlığı izleme başlığı oluşturduğu kaydedildi. Alihan Kuriş'in eşi Seda Kuriş adına gayrimenkul kaydı bulunmazken, üzerine 2008 model Volkswagen Jetta ile 2023 model Mercedes-Benz C 200 4MATIC kayıtlı olduğu raporda yer aldı. Seda Kuriş'in daha önce sahibi olduğu Audi Q2'yi Eylül 2023'te devrettiği bilgisine de raporda yer verildi. Banka kayıtlarında, 5 Eylül 2023'te Mehmet Özmen'den Seda Kuriş'in hesabına 2 milyon 406 bin 650 lira geldiği, aynı gün bu tutarın 2 milyon 406 bin 344 lirasının Mercedes Benz Otomotiv Ticaret ve Hizmetler AŞ'ye aktarıldığı görüldü. Raporda, harç ödemesi dışında Seda Kuriş'in incelenen dönemdeki esas bankacılık hareketlerinin bu iki işlemden oluştuğu belirtildi. Yaklaşık 2,4 milyon liralık otomobil bedelinin üçüncü bir kişiden gelmesi nedeniyle Mehmet Özmen ile Seda Kuriş arasındaki hukuki veya ticari ilişkinin açıklığa kavuşturulması gerektiği raporda vurgulandı. Seda Kuriş'in babası Mustafa Kösemusul'un TAKBİS kayıtlarında, adına halen 3 taşınmaz bulunmasına karşın geçmişte 426 ayrı gayrimenkul alış ve satış işlemi gerçekleştirdiği görüldü. Kösemusul'un mevcut taşınmazları arasında Serdivan'da yaklaşık 53 bin 900 metrekarelik özel ormanda hisse, Adapazarı'nda iki katlı betonarme bina ve arsasının yüzde 50 hissesi ile Rize'nin Çayeli ilçesinde tarla ve çalılık hissesi yer aldı. Özel orman niteliğindeki taşınmaz üzerinde 84 icrai haciz, 30 kamu haczi, 3 ihtiyati haciz ve satışa arz şerhi bulunurken, Adapazarı'ndaki taşınmaz üzerinde 30 icrai haciz, 32 kamu haczi, 2 ihtiyati haciz ve 2 ayrı ipotek kaydı bulunuyor. Raporda, Kösemusul'un geçmiş bankacılık hareketleriyle çok sayıda şirket ortaklığı ve yöneticiliği de dikkate alınarak, 426 tapu işleminin ekonomik gerekçesi, taşınmazların alış ve satış bedelleriyle bu bedellerin banka kayıtlarındaki karşılığının soruşturma kapsamında incelenmesi gereken başlıklar arasında olduğu aktarıldı. Seda Kuriş'in kardeşi Ayşe Nur Bedir'in bankacılık işlem hacminin 2023'te önceki yıllara kıyasla yaklaşık 5 kat arttığı MASAK raporunda yer aldı. TAKBİS kayıtlarında Bedir adına bulunan 5 tarlanın tamamının 2 Ekim 2023'te kayda geçtiği ve işlemlerde Fikri Kama'nın karşı taraf olarak yer aldığı görüldü. Taşınmazların toplam yüzölçümü 18 bin 700 metrekare olarak kayıtlara geçti. Beş parselin tamamında ihtiyati haciz ve kira şerhleri, bazılarında satışa arz şerhi, birinde ise 400 bin liralık ipotek bulunduğu rapora yansıdı. Bedir'in üzerine 2023 model Mercedes-Benz EQE 350 4MATIC AMG ile 2024 model Volkswagen Golf kayıtlı olduğu, ayrıca Tria Botanik ve Tarımsal Yatırım şirketinde yüzde 95, Armiteks Dokuma Tekstil'de ise yüzde 100 ortaklığının bulunduğu raporda yer aldı. Raporda, aynı tarihte edinilen 5 parsel, lüks araçlar ve şirket ortaklıkları ile 2023'te başlayan yaklaşık 5 katlık mali hareket artışının kaynağının birlikte incelenmesi gereken başlıklar arasında olduğu ifade edildi. Seda Kuriş'in annesi Zeynep Kösemusul adına herhangi bir şirket ortaklığı, araç veya gayrimenkul kaydı bulunmazken, 2016-2026 dönemindeki banka hesaplarında 5 milyon 550 bin liranın üzerinde para girişi ve yaklaşık 3 milyon 800 bin lira para çıkışının olduğu tespit edildi. Banka hesaplarına 2024'te yaklaşık 1 milyon 600 bin lira, 2025'te 1 milyon 900 bin lira, 2026'nın incelenen döneminde ise 1 milyon 500 bin liranın üzerinde para girişi olduğu raporda yer aldı. Raporda, adına kayıtlı taşınmaz, araç veya şirket ortaklığı bulunmayan Zeynep Kösemusul'un hesaplarındaki para hareketlerinin kaynağının, aile bireyleriyle karşılıklı transferleri ve işlem açıklamalarının ekonomik faaliyetlerle uyumunun açıklığa kavuşturulması gereken hususlar arasında olduğu ifade edildi. Seda Kuriş'in kardeşi Yasemin Şimşek adına gayrimenkul kaydı bulunmazken, banka hesaplarında 2017-2026 döneminde yaklaşık 653 bin lira giriş ve 635 bin lira çıkış gerçekleşti. Raporda, 11 Ekim 2021'de Volkswagen Golf'ün Neşat Salih'e devredildiği, aynı gün Neşat Salih'ten Yasemin Şimşek'in hesabına 124 bin 700 lira geldiği ve Özön Petrol Petrol Ürünleri Otomobil Nakliye İnşaat şirketine toplam 368 bin lira gönderildiği bilgisi yer aldı. Raporda, söz konusu para hareketlerinin aynı tarihteki araç alım ve satış süreciyle ilişkili olabileceği, araç satış bedeliyle yeni araç edinim bedelinin ve banka hareketlerinin belgelerle eşleştirilmesi gerektiği belirtildi. Seda Kuriş'in kardeşi Merve Kösemusul adına şirket ortaklığı, araç veya gayrimenkul kaydı bulunmazken, 2018-2026 döneminde banka hesaplarında yaklaşık 922 bin lira giriş ve 717 bin lira çıkış gerçekleşti. Para hareketlerinde aile bireyleri ve aileyle bağlantılı şirketler yer aldı. Armiteks Dokuma Tekstil'den 2024-2026 döneminde Merve Kösemusul'un hesaplarına yüz binlerce liralık düzenli para girişleri gerçekleşirken, Ayşe Nur Bedir'den de para transferleri yapıldı. MASAK raporunda aile ve yakın çevre birlikte değerlendirildiğinde, Alihan Kuriş'in annesi Ayşe Gülderen Denizolgun Kuriş'in 646 ve Seda Kuriş'in babası Mustafa Kösemusul'un 426 tapu işlemine ulaşan taşınmaz hareketleri, Nevin Kuriş'ten Mahmut Sabri Kuriş'e, ardından Alihan Kuriş ve Hilmi Tuna Kuriş'e uzanan kuşaklar arası mülkiyet devirleri ile Seda Kuriş, Ayşe Nur Bedir ve diğer aile üyelerinin taşınmaz ve araç edinimleriyle aynı dönemlere denk gelen banka hareketleri olmak üzere üç başlık öne çıktı. Raporda, aile içinde ve üçüncü kişilere yapılan taşınmaz devirlerinin gerçek satış bedelleri, bu bedellerin banka sistemine yansıyıp yansımadığı, aynı gün veya yakın tarihlerde gerçekleştirilen ardışık tapu işlemleri, araçların finansman kaynakları ile kayıtlı gelir ve mal varlığı arasındaki uyumun soruşturma kapsamında incelenmesi gereken temel konular arasında olduğu ifade edildi. Ankara Cumhuriyet Başsavcılığınca yürütülen soruşturmada 13 Ağustos'ta 17 ilde eş zamanlı operasyon düzenlenmiş, aralarında "örgüt yöneticisi" olduğu belirtilen Alihan Kuriş'in de bulunduğu 49 şüpheliden 30'u gözaltına alınmış, Alihan Kuriş ile bazı şüphelilerin tutuklanmasına hükmedilmişti. Soruşturmada şüphelilere "suç örgütü kurma ve yönetme", "suç örgütüne üye olma", "suçtan kaynaklanan mal varlığı değerlerini aklama", "kamu kurum ve kuruluşları zararına dolandırıcılık", "Vergi Usul Kanunu'na muhalefet" suçlamaları yöneltiliyor.
