Kongre ara seçimleri yaklaşırken, Virginia Yüksek Mahkemesi'nin bugün açıkladığı bir karar, Washington'daki siyaset gündemini sarstı. Virginia Yüksek Mahkemesi Yargıcı Arthur Kelsey, söz konusu seçimlere ilişkin kararda, "referandumların seçmenlere nasıl sunulacağını düzenleyen eyalet yasasına" atıfta bulunarak, 21 Nisan'daki seçimlerin bu yasayı ihlal ettiğini belirtti. Yargıç Kelsey, çoğunluk görüşünde, "Eyalet yönetimi, ara seçim şartını ihlal eden benzeri görülmemiş bir yöntemle Virginia seçmenlerine bir anayasa değişikliği önerisi sundu. Bu ihlal, referandum oylamasının bütünlüğünü telafisi imkansız bir şekilde zedeliyor ve oylamayı geçersiz kılıyor." ifadesine yer verdi. Mahkemeden yapılan açıklamada, 2021 yılında kabul edilen seçim bölgesi haritası ile kasım ayındaki seçimlere gidilmesine karar verildiği belirtildi. Demokratlar için büyük bir "kayıp" anlamına gelen söz konusu mahkeme kararı, başta ABD Başkanı Donald Trump olmak üzere Cumhuriyetçiler tarafından büyük bir memnuniyetle karşılandı. Trump, konuya ilişkin Truth Social hesabından yaptığı paylaşımda, "Virginia'daki karar, Cumhuriyetçi Parti ve Amerika için büyük bir zafer. Virginia Yüksek Mahkemesi, Demokratların korkunç seçim bölgesi sınırlarını iptal etti." ifadesini kullandı. 21 Nisan'da Virginia'da yapılan seçimlerde Cumhuriyetçilerin yüzde 48,5 "hayır" oyuna karşılık Demokratların ve bağımsızların yüzde 51,5'lik "evet" oyu ile "seçim bölgelerinde değişiklik" önerisi kabul edilmişti. Söz konusu düzenleme, iki partili seçim bölgesi düzenleme komisyonunu devre dışı bırakarak, Virginia'nın Demokratların liderliğindeki Genel Kurulu tarafından çizilen yeni seçim bölgelerinin kullanılmasına izin veriyordu. İlgili düzenleme, eyaletin Temsilciler Meclisi'ne göndereceği 11 temsilcinin parti dağılımını önemli ölçüde Demokratlar lehine değiştirerek, mevcut durumda 6 sandalye kazanabilecek olan Demokratların en az 10 sandalye kazanmasını mümkün hale getiriyordu. ABD'de 3 Kasım 2026'da yapılacak Kongre ara seçimleri öncesinde ülke genelinde Demokratlar ile Cumhuriyetçiler arasında "seçim bölgelerini yeniden düzenleme" mücadelesi yaşanıyor. Hangi partinin Kongre'ye daha fazla temsilci göndereceğini önemli ölçüde belirleyen seçim bölgesi düzenlemeleri, ABD'de "seçim bölgesi manipülasyonu (gerrymandering)" başlığı altında tartışılıyor. Söz konusu tartışma, ABD Başkanı Trump'ın geçen yıl Texas'taki Cumhuriyetçilere seçim bölgelerini yeniden düzenleme çağrısı yapması ve ağustos ayında kabul edilen yeni düzenleme ile Cumhuriyetçilerin ilave 5 Kongre sandalyesi kazandıracak bir sonuca ulaşmasıyla büyümüştü. Daha sonra harekete geçen Demokratlar da daha güçlü oldukları eyaletlerde benzer oylamaların yapılmasını sağlayarak Kongre seçimleri öncesinde avantaj sağlamaya çalışmışlardı. Texas'ın ardından California'da geçen yıl kasım ayında yapılan oylamadan Demokratlar, ilave 5 sandalye elde edecek bir sonuçla çıkmıştı. Benzer oylamaların yapıldığı eyaletlerde Cumhuriyetçiler, Missouri'de 1, Ohio'da 2, Kuzey Carolina'da 1 sandalye, Utah'ta ise Demokratlar ilave 1 sandalye avantajı sağlamıştı.
