Yapılmasına Dair Kanun Teklifi, TBMM Genel Kurulu'nda kabul edilerek yasalaştı. AA muhabirinin derlediği bilgilere göre, Kanun ile 15 yaş altı çocukların sosyal medya kullanımına yönelik yapılan düzenlemeye ilişkin 5 soru ve yanıtları şöyle: 1- Çocuklara sosyal medya yasaklanacak mı? Düzenleme ile 15 yaş altı çocuklara yönelik güvenli dijital alanlar oluşturulacak, kontrollü kullanım teşvik edilecek. Yaş doğrulama sistemleriyle çocukların yaş ve gelişimlerine uygun olmayan içeriklere maruz kalmaları önlenecek. İnternet Ortamında Yapılan Yayınların Düzenlenmesi ve Bu Yayınlar Yoluyla İşlenen Suçlarla Mücadele Edilmesi Hakkında Kanun'da yer alan "içeriğin yayından çıkarılması ve erişimin engellenmesi" başlıklı hükümde yapılan düzenlemeyle, sosyal ağ sağlayıcı 15 yaşını doldurmamış çocuklara hizmet sunamayacak ve bu hizmetin sunulmaması konusunda yaş doğrulama dahil gerekli tedbirleri almakla yükümlü olacak. Sosyal ağ sağlayıcı, 15 yaşını doldurmuş çocuklara özgü ayrıştırılmış hizmet sunma konusunda gerekli tedbirleri alacak. Bu kapsamda alınan tedbirler sosyal ağ sağlayıcının kendi internet sitesinde yayınlanacak. 2 - Ebeveyn denetimleri nasıl olacak? Sosyal ağ sağlayıcıları açık, anlaşılır ve kullanıma elverişli ebeveyn kontrol araçları oluşturacak. Ebeveyn kontrol araçları ise hesap ayarlarının kontrol edilmesine, satın alma, kiralama ve ücretli üyelik gibi ücrete dayalı işlemlerin ebeveyn iznine veya onayına tabi kılınmasına ve kullanım süresinin izlenmesi ve bu sürenin sınırlandırılmasına ilişkin mekanizmaları içerecek. Sosyal ağ sağlayıcıları, aldatıcı reklamları engelleyici tedbirleri almakla da yükümlü olacak. 3 - Sosyal ağ sağlayıcılarına nasıl yaptırımlar uygulanacak? Türkiye'den günlük erişimi 10 milyondan fazla olan sosyal ağ sağlayıcıları, gecikmesinde sakınca bulunan hallerde verilen kararın gereğini derhal ve en geç bir saat içinde uygulayacak. Kanun uyarınca verilen içeriğin çıkarılması veya erişimin engellenmesi kararlarına konu yayının kendi internet sitesinde yayınlanmaması hususunda gerekli her türlü tedbiri alacak. Verilen idari para cezasının tebliğinden itibaren 30 gün içinde yükümlülüğün yerine getirilmemesi durumunda Bilgi Teknolojileri ve İletişim Kurumu (BTK) Başkanı tarafından Türkiye'de mukim vergi mükellefi olan gerçek ve tüzel kişilerin ilgili sosyal ağ sağlayıcısına yeni reklam vermesi yasaklanacak, bu kapsamda yeni sözleşme kurulamayacak ve buna ilişkin para transferi yapılamayacak. Reklam yasağı kararının verildiği tarihten itibaren 3 ay içinde yükümlülüğün yerine getirilmemesi halinde BTK Başkanı, sosyal ağ sağlayıcılarının internet trafiği bant genişliğinin yüzde 50 daraltılması için sulh ceza hakimliğine başvurabilecek. Bu hüküm, düzenlemenin yayımı tarihinden 6 ay sonra yürürlüğe girecek. 4 - Oyun platformlarının yükümlülükleri ne olacak? Kanunla oyun platformlarına ilişkin yapılan düzenlemelere göre, oyun platformu usulüne uygun olarak derecelendirilmeyen oyunları sunamayacak ancak derecelendirilmeyen oyunları en yüksek yaş kriterine göre derecelendirmek kaydıyla sunabilecek. Oyun platformu içerik veya yer sağlayıcı olmasından doğan sorumluluk ve yükümlülükleri saklı kalmak kaydıyla usulüne uygun olarak derecelendirilmeyen içerikleri çıkarmakla yükümlü olacak. Türkiye'den günlük erişimi 100 binden fazla olan yurt dışı kaynaklı oyun platformu, BTK, Erişim Sağlayıcıları Birliği, adli veya idari makamlarca gönderilecek tebligat, bildirim veya taleplerin gereği ile düzenleme kapsamındaki diğer yükümlülüklerin yerine getirilmesini temin için Türkiye'de gerçek veya tüzel kişi temsilci belirlemek ve bu temsilciye dair bilgileri BTK'ye bildirmekle yükümlü olacak. Oyun platformu, temsilcinin iletişim bilgilerine kolayca görülebilecek ve doğrudan erişilebilecek şekilde internet sitesinde yer verecek. Oyun platformu, açık, anlaşılır ve kullanıma elverişli ebeveyn kontrol araçları sağlayacak. Ebeveyn kontrol araçları, hesap ayarlarının kontrol edilmesine, satın alma, kiralama ve ücretli üyelik gibi ücrete dayalı işlemlerin ebeveyn iznine veya onayına tabi kılınmasına ilişkin mekanizmaları içerecek. 5 - Oyun platformları yükümlülüklerini yerine getirmezse ne olacak? Oyun platformunun uyması gereken yükümlülüklere ve yaş kriterlerine göre derecelendirmeye dair usul ve esaslar, BTK tarafından çıkarılan yönetmelikle belirlenecek. Yükümlülükleri yerine getirmeyen oyun platformuna BTK tarafından bildirimde bulunulacak. Bildirimden itibaren 30 gün içinde bildirime konu yükümlülüğün yerine getirilmemesi halinde oyun platformuna BTK Başkanı tarafından 1 milyon Türk lirasından 10 milyon Türk lirasına kadar idari para cezası verilebilecek. 30 gün içinde bildirime konu yükümlülüğün yerine getirilmemesi halinde 10 milyon Türk lirasından 30 milyon Türk lirasına kadar bir kez daha idari para cezası verilebilecek. İdari para cezası miktarı ihlalinin niteliği, ağırlığı, kullanıcılar üzerindeki etkisi veya meydana gelen zarar dikkate alınarak takdir edilecek. İkinci kez verilen idari para cezasının tebliğinden itibaren 30 gün içinde bildirime konu yükümlülüğün yerine getirilmemesi halinde BTK Başkanı, oyun platformunun internet trafiği bant genişliğinin yüzde 30 oranında daraltılması için sulh ceza hakimliğine başvurabilecek.
