Davalı kadın L.Z, evliliklerinde eşinin de kusurlarının bulunduğunu ileri sürerek karşı dava açtı. Yargılamayı yapan İs­tan­bul 11. Aile Mah­ke­me­si, davacı erkek D.Z'nin daha ağır kusurlu olduğunu, evlilik birliğinin temelden sarsıldığını tespit ederek tarafların boşanmasına, ayrıca kadına yoksulluk nafakası bağlanmasına hükmetti. İstinaf başvurusu üzerine dosyayı inceleyen İstan­bul Böl­ge Ad­li­ye Mah­ke­me­si 42. Hu­kuk Da­ire­si de yerel mahkeme kararını uygun buldu. Bunun üzerine davacı D.Z, taraflara kusur belirlenmesi ile nafaka yönünden yerel mahkemeler tarafından verilen karara itiraz etti. Temyiz itirazını inceleyen Yargıtay 2. Hukuk Dairesi, boşanma ve diğer hususlar yönünden verilen kararları uygun bularak onadı ancak kadına bağlanan "yoksulluk nafakası" yönünden ise yerel mahkeme kararını bozdu. Dairenin kararında, Türk Medeni Kanunu'nun 175. maddesine atıf yapılarak, "Boşanan eş yararına yoksulluk nafakasına hükmedebilmek için nafaka talep eden eşin boşanma yüzünden yoksulluğa düşecek olması gerekir." değerlendirmesine yer verildi. Temyize konu davada, yerel mahkemenin kadına nafaka ödenmesine karar verdiği anımsatılan kararda, kadının yurt dışından emekli olduğu, düzenli gelirinin bulunduğu ve boşanmayla yoksulluğa düşmeyeceği ifade edildi. Yerel mahkemece bu durumun değerlendirilmeden kadın yararına nafaka ödenmesine hükmedildiği aktarılan kararda, "Davalı kadının yoksulluk nafakası talebinin reddine karar verilmesi gerekirken yazılı şekilde kabulü usul ve kanuna aykırı olup, bozmayı gerektirmiştir." değerlendirmesi yer aldı.
