Cumhuriyet Başsavcılığı Özel Soruşturma Bürosu koordinesinde yürütülen soruşturma kapsamında, İstanbul Emniyet Müdürlüğü Mali Suçlarla Mücadele Şube Müdürlüğünce yapılan çalışmalar neticesinde, Üsküdar Belediye binası içerisinde, belediye iştiraki olan Kent AŞ Genel Müdürü N.A'ya, yapı ruhsatı ve iskan ruhsatının verildiği birimler olan İmar ve Şehircilik Müdürlüğü ile Yapı Kontrol Müdürlüğü arasında bir oda tahsisinin yapıldığı ve N.A'nın oda isimliğinde de "başkan yardımcısı" ünvanını kullandığı belirlendi. Şüpheli N.A'nın çok sayıda resmi organizasyonda ve programda "belediye başkan yardımcısı" olarak sunulduğu, gerçekte sunulmayan bir hizmetin karşılığında görev ve yetkisi bulunmayan Üsküdar Belediyesi iştiraki Kent AŞ'nin paravan olarak kullanılmak suretiyle yapı ruhsatı sürecinde müteahhitlerden yasa dışı gelir elde edildiği ve yapı ruhsatı için sorumlu belediye biriminin İmar ve Şehircilik Müdürlüğü olduğu, buna rağmen müteahhitler ile Kent AŞ arasında yapı ruhsatı verilmesine ilişkin görüşmelerin gerçekleştirildiği tespit edildi. Yapı ruhsatı verilmesi sürecinde yetkileri olmamasına karşın Kent AŞ görevlilerinin, İmar ve Şehircilik Müdürlüğü görevlilerini denetlediği, Müdürlüğün yapı ruhsatı başvurularında hangi başvuruların ilerletileceği, hangi başvuruların askıya alınacağı yönündeki talimatlarını öğrenebilmeleri için kriptolu-kapalı devre iletişim ağı ile ada parsel bazlı renklendirmeler yapılarak excel tablosu oluşturulduğu ve renklendirme metoduna göre de yapı ruhsatını verecek yetkili birim olan Müdürlükçe kendilerine başvuru yapan müteahhitin ilgili ada parseli karşısında mail içeriğindeki ilgili satırın renklendirilmesine göre işlemlerin ilerletildiği ya da işlem tesis edilmediği öğrenildi. Kent AŞ ile İmar ve Şehircilik Müdürlüğü arasında kripto ve kapalı devre iletişim ağı olan mail içeriğindeki excel listesinde ada parsellerin bulunduğu, her satırın karşısına mavi, kırmızı, yeşil ve turuncu olacak şekilde renklendirme yapıldığı ve renklendirme metoduna göre kodlanan iletişim ağı doğrultusunda ada parsellerin bulunduğu tespit edilen dosyalarda, "mavi" renkte olmasının anlaşmanın sağlandığı ve işlerin yürütülmesi gerektiği, "kırmızı" renkte olmasının anlaşmanın sağlanamadığı, işlemlerin yürütülmemesi gerektiği, "yeşil" renkte henüz görüşmenin gerçekleşmediği, işlemlerin yürütülmemesi gerektiği, "turuncu" renkte ise ilgilisiyle görüşme yapıldığı ancak işin resmiyete dökülmediği, yeni bir talimat verilmesi durumunda işlemlerin ilerletilmesi anlamına geldiği belirlendi. Soruşturma kapsamında, mimari projeye göre değil, talep edilen tutarın yatırılıp yatırılmamasına göre yapılan renklendirmeye istinaden işlem tesis edilerek yapı ruhsatı verildiği, iskan ruhsatının verilmesinden sorumlu birimin ise belediyenin Yapı Kontrol Müdürlüğü olmasına karşın iskan ruhsatı için müteahhitlerden hangi menfaatin ne şekilde talep edileceğine Kent AŞ Genel Müdürü N.A'nın başkanlığında yapılan toplantılarda karar verildiği, bu toplantılara iskan ruhsatını onaylayan Belediye Başkan Yardımcısı Filiz Deveci'nin de katıldığı tespit edildi. Belediyede görevli mühendislerin iskan ruhsatı süreci işletilen inşaatların denetimlerini yaptıkları, bu denetimler sonucunda mevzuata aykırılıkları tespit ettikleri, bu tespitlere dair dijital verilerin yapı kontrol müdürlüğündeki görevli müdür ve teknik ekibi tarafından N.A'ya değerlendirme yapması noktasında toplantılarda sunulduğu, bu değerlendirmenin belediye binası içerisindeki N.A'ya tahsis edilen odada toplantı yapılması suretiyle gerçekleştirildiği ve bu toplantıya Belediye Başkan Yardımcısı Deveci'nin de katıldığı bilgisine ulaşıldı. Yapı Kontrol Müdürlüğündeki görevliler tarafından, toplantılarda her bir inşaatın mevzuata aykırılık niteliğine göre ve yine inşaatın yapıldığı yerin metrekare cinsinden değeri nazara alınarak iskan ruhsatı karşılığında müteahhitlerden ne kadar menfaat talep edileceğine karar verildiği, yine bu toplantıda müteahhitin menfaati nasıl sağlayacağının kararlaştırıldığı, şüpheliler N.A. ve Deveci'nin kararı doğrultusunda ilgili müteahhit yapı kontrol müdürlüğüne davet edilerek iskan ruhsatı karşılığında toplantıda alınan karar uyarınca kendisinden veya iş takipçisinden menfaat talebinde bulunulduğu saptandı. Söz konusu iddialara ilişkin yürütülen soruşturma kapsamında, Üsküdar Belediyesinde yapı ve iskan ruhsatı verilmesindeki belirtilen usulsüzlüklere ilişkin rüşvet suçu teşkil edecek eylemlere istinaden İstanbul ve Yalova'da 30 adrese düzenlenen eş zamanlı operasyonda, aralarında Kent AŞ Genel Müdürü N.A. ve Üsküdar Belediye Başkan Yardımcısı Filiz Deveci'nin de bulunduğu 20 şüpheli gözaltına alındı.
