Ağır Ceza Mahkemesi'nde yapılan yargılamanın ardından, cumhuriyet savcılığının "kasten öldürme" suçundan müebbet hapis cezasına çarptırılmalarını istediği sanıklardan Serhan Yavuz Çiftçi'ye, "kasten yaralama sonucu ölüme neden olma" suçundan 7 yıl 6 ay hapis cezası verildi. Diğer sanık Cenk Faruk Döner ise beraat etti. Mahkemenin gerekçeli kararında, maktul Bayram Gündoğdu ve sanık Serhan Yavuz Çiftçi'nin, 2 Temmuz 2024'te aralarındaki alacak verecek mevzusu nedeniyle Zeytinburnu'nda buluştukları, sokakta yaşanan kavgada darbedilen Gündoğdu'nun fenalaştığı belirtildi. Kararda, Çiftçi'nin Gündoğdu'yu, aralarındaki alacak verecek meselesine vesile olduğu gerekçesiyle diğer sanık Cenk Faruk Döner'in aracının arka koltuğuna koyarak, kendisi de başka arabayla amcası tanık Yavuz Selim Çiftçi'nin iş yerine gittikleri anlatıldı. Sanık Çiftçi'nin, amcasına araçta baygın vaziyette olan Gündoğdu'nun hastaneye götürülmesi gerektiğini söylediği, Gündoğdu'yu diğer sanık Döner'in Yedikule Göğüs Hastalıkları ve Göğüs Cerrahisi Eğitim ve Araştırma Hastanesi'ne götürüp bıraktığı kaydedildi. Kararda, Adli Tıp Kurumu tarafından, "Kişinin ölümünün, maruz kaldığı darp olayının stresi tetiklemesiyle yüksek tansiyona bağlı beyin kanaması ve gelişen komplikasyonlar sonucu meydana gelmiş olduğu, maruz kaldığı darp olayına bağlı yaralanması ile ölüm arasında tıbben illiyet bağı bulunduğu ancak mevcut yüksek tansiyon hastalığının ölüm üzerine etkisi ve katkısının olacağı oybirliği ile mütalaa olunur." şeklinde rapor verdiği aktarıldı. Kararda, Serhan Yavuz Çiftçi'nin maktulün kafa bölgesine iki kez yumruk atmış olması, Adli Tıp Kurumu raporunda maktulün darbedilmesiyle beyin kanaması neticesinde ölümün gerçekleşmesi arasında illiyet bağı bulunduğunun tespit edilmesi ve olayın gerçekleşme şeklinin dikkate alındığı vurgulandı. Çiftçi'nin baştan itibaren maktulü öldürme kastı ile hareket ettiği yönünde her türlü şüpheden uzak bir delil elde edilemediğine hükmedilen kararda, "Yine tanık Yavuz Selim Çiftçi'nin iş yerinden alınan ses ve görüntü kaydeden güvenlik kamera görüntüsü birlikte değerlendirildiğinde, sanığın yukarıda açıklanan gerekçelerle sabit görülen 'maktule iki kez yumruk atması neticesinde maktulün beyin kanaması geçirerek ölümüne sebep olması' şeklindeki eyleminin, 'kasten yaralama sonucu ölüme neden olma' suçunu oluşturduğu" ifade edildi. Bu gerekçelerle, sanık Serhan Yavuz Çiftçi'ye "kasten yaralama sonucu ölüme neden olma" suçundan 7 yıl 6 ay hapis cezasının verildiği kaydedildi. Mahkemenin gerekçeli kararında, diğer sanık Cenk Faruk Döner'in ise tesadüfen olay yerinden geçerken olaya denk geldiğine dikkati çekildi. Sanık Çiftçi ile maktul Gündoğdu arasında gerçekleşen tartışma ve arbedede sanık Döner'in maktule hukuka aykırı bir eyleminin bulunmadığı, tarafları ayırmaya çalıştığı, dosyada aksini gösterir bir delilin de bulunmadığı belirtilen kararda, sanık Cenk Faruk Döner'in üzerine atılı "kasten öldürme" suçunu işlediğine dair her türlü şüpheden uzak, mahkumiyete yeter nitelik ve derecede kesin, inandırıcı delil elde edilemediği vurgulandı. Kararda, suçun sanık Döner tarafından işlendiği sabit olmadığından bu sanığın beraatına hükmedildiği kaydedildi. Maktulün ailesi ile ceza alan sanık Serhan Yavuz Çiftçi ise karara itiraz ederek istinaf yoluna başvurdu. Aile, her iki sanığın da savcılığın iddianamesinde talep edildiği gibi, "kasten öldürme" suçundan müebbet hapisle cezalandırılmalarını istedi. Sanık Çiftçi ise kendisinin de beraatine karar verilmesini talep etti. Dava dosyasıyla ilgili istinaf incelemesini yapan İstanbul Bölge Adliye Mahkemesi 1. Ceza Dairesi, istinaf başvurularını reddetti ve Bakırköy 22. Ağır Ceza Mahkemesinin kararını hukuka uygun buldu. Taraflar, istinaf kararına karşı da Yargıtay'a temyiz başvurusunda bulundu.
